Hartbeat, LLC (“Hartbeat”   “we”, “us”, “our”) is committed to protecting the privacy and security of the data we collect and being transparent about the ways in which we collect and process your data. This statement (the “Privacy Policy”) sets forth our policies and practices for handling the data we collect from or about you. It applies to the websites and online services that we operate and that link to this Privacy Policy (the “Service”).

1.         Data We Collect

a.         Data You Provide to Us. You may provide information directly to us when using the Services, such as when you create an account with us, including, but not limited to the following:

·       Contact data, including your name, alias, profile name, email address and mailing address.

·       Financial data, including information you may submit to us as part of the registration process, such as payment card details and billing address.

·       Profile data, including information you may submit to us when you create an account, such as topics that interest you and a brief bio.

·       User content data, including information you may make available to us when using the Service. Any information you share on the Service may become public knowledge.

·       Capture form data, including the information you choose to submit through a capture form set up by the owner of a video or content.

·       Other correspondence you send to us.

b.         Data We Collect Automatically. When you use our Service, we collect internet, electronic activity, and other information automatically from the devices and browsers that you use, including your IP address, your approximate location, the date and time of your visits, the pages you visit, browser type, the content you clicked on, the content you liked or disliked, content you paused, played back or resumed, operating system, device information, the full Uniform Resource Locator (URL) clickstream to, through and from our sites, including any search queries you entered to reach our Service. We may also collect information regarding your search queries on our Service. Some of this data may be collected through cookies, pixels, and similar technologies. For more information on our use of those technologies, please see Section 4 below.

c.         Data We Collect From Third Parties. We may also receive the categories of information described above from other sources, including from other users of the Service and third-party services and organizations. For example, if you set up an account through a third-party platform, like a social media service, you may give us permission to access the profile you have with that third party, including any information on that profile, like your photo.

We may aggregate or de-identify the information described above.  Aggregated or de-identified data is not subject to this Privacy Policy.

2.         Why We Use Your Data. We use your information for our legitimate business purposes, specifically including the following:

a.         Customization: We use your data to understand how you use our Service, and, to the extent possible, customize our Service to your needs. This includes using data regarding your search engine results or viewing choices so that we can suggest further videos, creators, courses, products and services that may interest you.

b.         Improvement: We may also use your data to support, develop, and improve the Services.

c.         Communication: We use your data to communicate with you regarding your account and use of the Service. We also use your data to allow other users to communicate with you.

d.         Marketing: We use your data to customize the types of advertisements you see while using the Service. We may use your data to provide you with news and special offers and general information about other goods, services and events. We may now or in the future allow advertisers and corporate partners to post content on the Service and provide links to sites and content of third parties as a service to those interested in this information.

e.         Conduct the Service: We use your data to operate the Service–this includes, but is not limited to, loading the Service accurately for you, charging your account, and making you aware of offers and updates. This may include passing your financial information to third party service providers to fulfill any orders you have made. We use your data to contact you about changes to the Service. We use your data to allow you to participate in interactive features of the Service. We use your data to provide customer service and to detect, prevent and address technical issues.

f.            Business Purposes: We may use your data for our own business purposes, including accounting, financial reporting, tax filings, business planning, or any other legitimate business purpose.

g.          Security Purposes: We use your data to prevent, detect or investigate safety and security concerns on the Service, including fraud, such as using your data to fix any bugs or other problems that arise.

h.         Legal Purposes: We use your data to comply with applicable laws, regulations, or industry standards and to defend our legal rights.

3.         How We Share Your Data. We may share your data with, and make your data available to, the following parties:

i.            Other Users: Depending on your privacy settings, you may share your data, such as your profile data, and other content with other users of the Services.

j.            Authorized Service Providers and Third-Party Vendors: We may share your data with third-party vendors and service providers that help us operate the Service and provide services to us for a variety of business purposes, such as hosting services, payment processing, email deployment, processing and fulfilling orders, and content delivery.

k.          Advertising, marketing, and analytics partners. We may share your data with our advertising, marketing, and analytics partners so that they can provide their services to us, such as through cookies and similar technologies (as discussed further in Section 4 below).

l.            Corporate affiliates.  We may share your data with our corporate affiliates.

m.      Business transfers. We may share your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sale, initial public offering, or in the unlikely event of bankruptcy.

n.         Legal Disclosures: We may share your data if legally required to do so, or if we believe we are legally required to do so, such as to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, and to protect and defend the rights, interests, safety, and security of Hartbeat. We may share your data if we believe a person’s life may be at risk or to report suspected crimes like content suspected of exploiting minors. We may disclose your data to prevent fraud. We may also disclose your data in connection with legal claims against us or one of our users. We may disclose your data to protect our property rights, or the legal rights of our affiliates, customers or third-party vendors or service providers, or to protect against potential legal liability.

o.         With your consent. We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent. 

4.         How We Use Cookies. We and our third-party partners may use cookies and similar technologies, such as pixels, JavaScript, and web beacons, (collectively, “Cookies”) for various purposes, including to measure web traffic and usage, improve our Service, to deliver content which suits your interests, and for other lawful reasons. By using our Service you also agree to our use of Cookies.

We and our third-party partners may use the following types of Cookies on the Service:

·       Necessary Cookies: These cookies are required for the Service to function.. These Cookies allow you to move through our Service and use its features, including basic things like page navigation, and logging in.

·        Preference Cookies: These Cookies help customize the user experience by allowing us to remember the preferences you have chosen like your language of preference and region.

·       Performance and Analytics Cookies: These Cookies help us understand how Users interact with our Service–meaning what pages Users visit and do not visit and where they spend their time. These Cookies collect and report anonymous data which helps us improve our Service.

·       Security Cookies: These Cookies help us to protect the security and integrity of the Service.

5.          Data Retention. Information will be retained only for so long as reasonably necessary and proportionate for the purposes set out above and consistent with our retention policies, considering criteria such as the duration of our relationship with you, the sensitivity of the relevant information, any applicable rules on statute of limitations, and any legal requirements to retain your personal information. For example, if you create an account with us we may retain your data as long as you maintain that account with us.

6.         Data Protection. We employ various reasonable measures to protect your data from unauthorized access, misuse or loss. These means include encryption, pseudonymization, and aggregation. Regardless of the means we have in place to protect your data, no network, email, or online transmission is completely secure and foolproof. Accordingly, you share your data at your own risk and should be careful what data you decide to share and to protect your data.

7.         Your Rights and Choices. Depending on where you live, you may be entitled under applicable law to request access to your personal information (including in a portable copy) and other information about our processing practices. You may also have the right to request the deletion or correction of the personal information we maintain about you. To submit one of these requests [please contact us as set forth below in the “Contact Us” section below]. You may also have the right to appeal any decision we have made about your request through these same methods. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity.  We will not retaliate against you for exercising your rights and choices, although some aspects of the Service may no longer be available to you.

You may be entitled, in accordance with applicable law, to submit a request through an authorized agent.  To designate an authorized agent to exercise your rights and choices on your behalf, please provide evidence that you have given such agent power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.

[While we do not sell your personal information for money, we may process it for purposes of serving you advertisements based on your activity across other sites and services (“targeted advertising”). You may have the right to opt out of sale or the processing of your information for targeted advertising. Some mobile and web browsers transmit "do-not-track" signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

Note that we do not engage in profiling which results in legal or similarly significant effects, as defined under applicable law, nor do we process any sensitive personal information for purposes other than to provide the Service or for other permitted purposes under applicable law.

You also have other privacy-related choices available to you through the Service. For example, you may use your app settings to change or correct any profile data you provide to us and to modify your privacy settings.  You may also opt out of marketing emails you receive from us by clicking on the opt out link at the bottom of the message.

8.         Third-Party Sites. As part of your use of the Service, you may come in contact with third party links to other websites. We cannot control the use of your data on these other sites and do not endorse any of them. To verify how your data is being used on these other sites, you should review their privacy policies or other policies.

9.         Children’s Privacy. We do not knowingly collect or sell any information from children, as defined by applicable law, without parental consent or as otherwise permitted by applicable law. 

10.   Changes to the Privacy Policy. We may modify this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the “Effective Date” date above and post the new Privacy Policy.  We recommend that you review the Privacy Policy each time you visit the Services to stay informed of our privacy practices.
